In the light of the short blossom lime of the plant variety at issue in the petition, the urgency to intervene appears to be justified, and consequently also the franting of the inaudita altera parte description-measure. The petitioning party is authorised to carry out the description both at the premises which are at the opposing party's disposal, and at the premises of third parties, who did receive the plants deemed to infringe the counterpart's patent rights.
